Terms and Conditions

These terms apply to the use of imotfoto (the “Service”), an online service for automatically enhancing real-estate photos. By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service. You can ask questions via info@imotfoto.com.

imotfoto enhances uploaded real-estate photos using artificial intelligence. The Service works with credits: each edit consumes a predetermined number of credits. Which editing tools are available depends on the chosen plan.

You are responsible for the accuracy of your account data and for keeping your login details confidential. Activities that take place via your account are your responsibility. If you suspect misuse, please contact us as soon as possible.

We grant you a limited, non-exclusive, non-transferable and revocable right to use the Service for your own (business) real-estate photography, in accordance with these terms.

You retain full ownership of the photos you upload and of the enhanced results. You grant us only the right to process and store your photos to the extent needed to deliver the Service.

You warrant that you have the right to use the uploaded photos and to have them edited, and that in doing so you do not infringe the rights of others. Because an edit must not misrepresent reality, you are yourself responsible for ensuring that an enhanced photo continues to give a fair and accurate impression of the property. How we handle your data is explained in our privacy policy, which forms part of these terms.

• Payment runs through Stripe (iDEAL and credit card).
• Prices are in euros; whether VAT is included is stated alongside the prices.
• Purchased credits are personal and cannot be transferred to third parties.
• Unused credits remain valid for as long as your account is active.

The Service is a digital service that is available immediately after purchase. If you are a consumer, you in principle have fourteen days to reconsider. By purchasing credits and starting to use the Service immediately, you expressly consent to immediate delivery and acknowledge that you lose the right of withdrawal as soon as you have used credits. For credits that are still entirely unused you can contact us within the reconsideration period.

It is not permitted to:

• Reverse-engineer, decompile or disassemble the Service;
• Misuse, overload or disrupt the Service;
• Resell the Service or the results as a standalone service to third parties;
• Use automated systems to access the Service without our permission;
• Upload unlawful material or infringe the rights of others.

We make every effort to keep the Service available, but cannot guarantee uninterrupted availability due to, for example, maintenance or outages at suppliers. We may change, add or remove features. For significant changes we will inform you in advance.

The Service is provided “as is”. AI edits may vary in quality and result. We do not guarantee that the Service works uninterrupted or error-free, or that every result meets your expectations.

Our liability is limited to the amount you paid for the Service in the twelve months preceding the event. We are not liable for indirect or consequential damage. This limitation does not apply in the case of intent or deliberate recklessness on our part, or to the extent that the law does not allow it.

You can cancel your account at any time. We may suspend or terminate your account in the event of a serious breach of these terms. After termination your access to the Service and to unused credits lapses; we delete your data in accordance with our privacy policy.

These terms are governed by Dutch law. We submit disputes to the competent Dutch court, to the extent the law does not mandatorily designate a different court.

We may amend these terms. We announce significant changes at least 30 days in advance by email and/or a notice in the Service. The date at the top of this page indicates the latest version.
